On May 3, 2007 the Republic of Uzbekistan published a new “Law on Charity”, putting the legislation into effect. ICNL has been working in Uzbekistan for several years and has tracked, and previously advised upon, the Law on Charity. The law is available here in English.
While primarily declaratory, the Law on Charity has potentially positive and negative provisions. Optimistically, the law establishes a basis for tax changes, especially significant in light of the ongoing effort of the Government to draft a new tax code. On the other hand, a provision of the new Law grants the Cabinet of Ministers the right to monitor and control charitable donations from foreigners, international and foreign organizations, potentially creating new barriers for foreign funders and local recipients of foreign aid.
