N o. 4 of 2010;
T he E m iri D ecree N o. 29 of 1996 on the decisions of the C oun cil of M inisters, w hich
are being subm itted to the E m ir for ratification;
T he E m iri D ecree N o. 40 of 2009 on the organizational structure of the M inistry of
S ocial A ffairs;
A nd upon the adoption by the C ouncil of M inisters at its regular m eeting N o. 33 of
2010, on 24/11/2010 of the draft resolution;

In im plem enting the provisions of this Resolution, the follow ing w ords and expressions shall have the m eanings
assigned thereto, unless the context requires otherw ise:
“D epartm ent” m eans the D epartm ent of Private Societies and Institutions.
“associations and foundations” m eans any private association and foundation registered and declared in
accordance w ith the provisions of L aw N o. 12 of 2004 and perm itted to collect donations as provided
herein.
“Perm it” m eans a w ritten approval issued by the M inister of Social A ffairs to any one of the private
associations and foundations to collect donations and financial transfers.
“D onations” m eans the collecting of m onetary or in­kind funds by a society or institution, w ithout
consideration, to be expended for charity and public utility purposes or to provide hum anitarian services.
“Transfers” m eans banking processes related to the m ovem ent of donated funds w ithin the state.
“Foreign transfers” m eans banking processes related to the m ovem ent of donated funds from and out of the
state.
“Beneficiaries” m eans any legal entity approved to receive perm itted donations or transfers for charity
purposes.

C h ap ter T w o: F u n d raisin g
A rticle 2
A ssociations and foundations m ay not engage in collecting donations w ithout first obtaining a perm it as
provided in the aforesaid L aw N o. 12 of 2004. Such perm it shall contain the follow ing inform ation:
N am e of licensed associations and foundations.
1. Purpose of donations
2. D uration of perm it.
3. M ethod of collection.
4. Specified locations for collection.
5. N am e of authorized collectors, their respective identity num bers, positions and dom iciles.

The association and foundation m ay, if necessary, apply for an extension to the period for w hich the perm it is
granted.

A rticle 4
The association and foundation shall have an active current account in its ow n nam e at one of the local banks.

A rticle 5
The association and foundation requesting a perm it to collect donations through bank deposit, transfer or
checks shall present its request to the departm ent for consideration. M oreover, foreign transfers shall not be
deposited into the account of the association and foundation but shall be held by the bank pending approval of
the perm it request by the departm ent.

A rticle 6
The association and foundation shall keep donations in boxes at specified locations in accordance w ith the
perm it, provided that the box shall be tightly locked glass w ith one sm all opening to allow for the insertion of
donated coins.



Each box shall clearly indicate its serial num ber, the nam e of the society or institution, and the stam p of the
departm ent reflecting the period for w hich the perm it has been granted. The lable containing the inform ation
shall be conspicuously displayed.

A rticle 7
A com m ittee com prising at least three m em bers, including the cashier, shall be constituted for each society or
institution. Such com m ittee shall, after receiving approval from the departm ent, undertake the opening of boxes
at the prem ises of the association and foundation upon notification to the departm ent of the date and hour
thereof.
The com m ittee shall subm it a report to the departm ent on the am ount of donations contained in each box and
shall deposit such am ount in the respective account of the association and foundation against an official receipt,
provided that such deposit shall occur not later than one day follow ing the opening of the boxes.

A rticle 8
The association and foundation shall, im m ediately upon expiration of the perm it, subm it to the departm ent a
detailed report approved by an accredited accountant indicating the am ount and details of donations, along w ith
the m ethod and aspects of disposal thereof. Supporting docum ents shall be enclosed w ith such report.

A rticle 9
The association and foundation shall not utilize such funds for any purpose other than that perm itted by the
departm ent.

The association and foundation shall furnish the departm ent w ith regular quarterly statem ents of all foreign
donations received during the period.

A rticle 11
Each association and foundation shall hold records and docum ents for registering all internal or external
procedures and shall m aintain such records and docum ents for a period of at least five years, m utatis m utandis,
from the date on w hich such records cease to be used or the date on w hich their account is closed.
Such associations and foundations shall regularly update the inform ation contained in such records and
docum ents and shall m ake them available to the D epartm ent or other com petent authorities in accordance w ith
the provisions of the aforesaid L aw N o. 4 of 2010, as w ell as to judicial authorities or investigators, if
requested.


C h ap ter T h ree: F oreign tran sfers
A rticle 12
The association and foundation m ay not conduct any foreign transfer for any purpose w ithout first obtaining a
perm it.

A rticle 13
The m anagem ent of the project to be financed shall apply to the association and foundation for assistance in
covering the costs of the project. Such application shall specify the purpose and execution schedule of the
project and shall be signed by the authorized m anager.

A rticle 14
A perm it for foreign transfers shall be granted under the follow ing conditions:
1. The application shall be subm itted by a association and foundation engaged in charitable and public
utility causes.
2. The purpose of the transfer shall be to finance a project for the beneficiary party engaged in charitable or
public utility causes or providing hum anitarian services, provided that actual need is established.
3. The application shall specify the am ount required to be transferred, the nam e of the beneficiary, and the
expected phases of execution. Supporting docum ents, properly attested by the Q atari em bassy or any
substitute in the country of the beneficiary, shall be enclosed w ith the application.
4. The association and foundation shall subm it the approval of the com petent Q atari authorities for
financing such project.
5. The association and foundation shall conduct regular field visits to the project in order to ensure its
existence and to control and m onitor the execution phases and developm ent thereof. The association and
foundation shall provide the departm ent w ith a report on the findings of such visits.

A rticle 15
The beneficiary shall:
1. Be a legal entity operating w ithin the law s of the state w herein the project is being executed.
2. Be engaged in charitable and public utility causes for the purpose of executing the project.
3. O perate a bank account in the country hosting such project.

A rticle 16
A pproval of an application for a foreign transfer perm it shall be issued upon satisfaction of the conditions
provided herein. The application shall indicate the nam e of the society or institution, the am ount to be
transferred, the beneficiary, and the bank account into w hich the funds for the project are to be transferred.

A rticle 17
The association and foundation shall m ake the foreign transfers w ithin tw o w eeks from the date of obtaining the
perm it; otherw ise the perm it shall be null and void.

A rticle 18
The association and foundation shall subm it to the departm ent regular quarterly statem ents on all foreign
transfers conducted w ithin the period, provided that such report shall indicate the com pletion stages of financed
projects.

A rticle 19
The association and foundation shall inform the D epartm ent, w ithout notice to any individual or entity, of any
donations and financial transactions suspected of com prising m oney laundering or the financing of terrorism in
violation of the aforesaid L aw N o. 4 of 2010. The association and foundation shall establish and m aintain
system s capable of providing data related to the identification and legal status of custom ers and actual
beneficiaries.


C h ap ter F ou r: G en eral P rovision s

W ithout prejudice to the provisions of any legally designated liability, the perm it shall be deem ed rescinded
w here the association and foundation violates any of provisions herein. The m inister m ay cancel such perm it
based on the requirem ents of the public interest.

A rticle 21
The departm ent shall establish the form s provided herein.

A rticle 22
A ll provisions violating the provisions herein shall hereby be rescinded.

A rticle 23
A ll com petent authorities, each in their respective jurisdiction, shall enforce this resolution from the date of its
publication in the O fficial G azette.
