The Resolution of the President o f Turkmenistan
on the state registration of the projects and programmes of foreign technical, financial and
humanitarian assistance and grants
of 14th November, 2003, № 6446

With the view to create the systematized d atabase on the registration of all kinds of the projects and
programmes of foreign technical, financial and humanitarian assistance and grants provided on
gratuitous basis by foreign states, international organisations, financial institutions, foreign
comp anies, public organisations and religious organisations as well as the natural entities of foreign
states to the ministries, departments of Turkmenistan and other recipients of foreign technical,
financial and humanitarian assistance and grants I enact:

1. To assign:
the State Agency for Foreign Investments under the President of Turkmenistan the functions of
registering the projects and programmes of foreign technical, financial and humanitarian assistance
and grants except the registration of the project s and programmes of such assistance and grants
provided for the public associations and religious organizations (hereinafter referred to as the
religious organizations ) registered in the territory of Turkmenistan.
To establish that the State Agency for For eign Investments under the President of Turkmenistan
shall keep records in the Unified State Registry of foreign technical, financial and humanitarian
assistance and grants.
The Ministry Adalat of Turkmenistan shall perform the functions of registering th e projects and
programmes of foreign technical, financial and humanitarian assistance and grants provided to
public associations and religious organisations registered in the territory of Turkmenistan.

2. To approve the enclosed “The Regulations on the registration of foreign technical, financial and
humanitarian assistance and grants in Turkmenist an and keeping records in the Unified State
Registry of foreign technical, financial and humanitarian assistance and grants”.
3. The Ministry Adalat of Turkmenistan shall conduct re -registration of the current projects and
programmes of foreign technical, financial and humanitarian assistance and grants provided to
public associations and religious organisations registered in the territory of Turkmenistan within a
one -month period.
4. The ministries, departments of Turkmenistan and other recipients of fore ign technical, financial
and humanitarian assistance and grants shall necessarily register the projects and programmes of
foreign technical, financial and humanitarian assistance and grants with the State Agency for
Foreign Investments under the President of Turkmenistan or the Ministry Adalat of Turkmenistan
respectively and submit the stage -by -stage and final reports on their implementation.

5. The State Commodity and Raw Materials Exchange of Turkmenistan and the State Customs
Service of Turkmenistan shall not execute the procedures of exchange and customs on the projects
and programmes of foreign technical, financial a nd humanitarian assistance and grants without
submitting the certification of registration of the said projects, programmes and grants with the State

Agency for Foreign Investments under the President of Turkmenistan or the Ministry Adalat of
Turkmenistan respectively and the extract from the Unified registry of foreign technical, financial
and humanitarian assistance and grants.

6. The State Agency for Foreign Investments under the President of Turkmenistan and the Ministry
Adalat of Turkmenistan shall ensure the prompt provision of the information of the
registered projects and programmes of foreign technical, financial and humanitarian assistance and
grants to the Ministry of Foreign Affairs of Turkmenistan for issuing the visas to foreign consultants
and specialists.

7. To determine that the violation of the procedure for the registration of foreign technical, financial
and humanitarian assistance and grants by public associations and religious organisations including
those unregister ed shall result in the liability under the legislation of Turkmenistan.
8. To declare the Resolution of the President of Turkmenistan of 11th January, 2002 №5497 “On
the state registration of the projects and programmes of foreign technical assistance” (the collected
decrees of the President of Turkmenistan and the decisions of t he Government of Turkmenistan,
2002 г., №1, p.12).
9. To make Vice Chairman of the Cabinet of Ministers of Turkmenistan D. Aydogdiev responsible
the control of the implementation of this Resolution.

The REGULATIONS
on the registration of the projects and programmes of foreign technical, financial and
humanitarian assistance and grants in Turkmenistan and the keeping records in the Unified
State Registry of foreign technical, financial and humanitarian ass istance and grants

1. These Regulations shall determine the procedure of the state registration of the projects and
programmes of foreign technical, financial and humanitarian assistance and grants in Turkmenistan
and the keeping records in the Unified St ate Registry of foreign technical, financial and
humanitarian assistance and grants (hereinafter referred to as Registry).
2. The state registration of the projects and programmes of foreign technical, financial and
humanitarian assistance (hereinafter ref erred to as all kinds of foreign technical assistance) and
grants shall be the official final administrative formal note permitting the implementation of the said
projects, programmes and grants in accordance with the laws of Turkmenistan.
The state regist ration shall be executing through issuing a special conclusion issued by the State
Agency for Foreign Investments under the President of Turkmenistan (hereinafter referred to as the
Agency) and the Ministry of Adalat of Turkmenistan respectively.

3. The projects and programmes of all kinds of foreign technical assistance shall be the projects,
programmes and grants implem ented in Turkmenistan by the assistance and out of the funds
provided on gratuitous basis by foreign states, international organizations, financial institutions,
foreign companies, public organizations and religious organizations as well as the natural ent ities of
foreign states to the ministries, departments of Turkmenistan other recipients.

4. The public bodies executing the registration of the projects and programmes of all kinds of
foreign assistance and grants in Turkmenistan shall be the Agency and th e Ministry of Adalat of
Turkmenistan.
The holder of the register is the Ministry of Economy and Finance of Turkmenistan.

5. The Registry shall be the systematized data base providing the information on all kinds of
registered in Turkmenistan foreign assistance and grants provided by foreign states,
International organizations, financial institutions, foreign companies, pub lic organizations and
religious organizations as well as the natural entities of foreign states to the recipients in
Turkmenistan
6. The main goals of the Registry shall be as follows:
to keep records in the unified state registry;
to compile the statutory and reference documentation used for the social and economic processes
management;
to ensure the monitoring of the registered projects and programme of all kinds of foreign assistance
and grants in Turkmenistan.
7. The data base of the Registry shall be f ormed on basis of the documents submitted for the state
registration of the projects and programmes of all kinds of foreign assistance and grants a well as
the data on the registration of the projects and programmes of all kinds of foreign assistance and
grants for public associations and religious organizations provided by the Ministry of Adalat of
Turkmenistan.

8. The data o n the state registration of the projects, programmes and grants as well as the changes in
their records shall be subject to the entry to the Registry
9. To obtain the state registration of the projects and programmes of all kinds of foreign assistance
and grants the ministries and departments of Turkmenistan and other recipients of foreign assistance
and grants shall submit the data on the planned, current and implemented projects and programmes
of all kinds of foreign assistance and grants to be registered and inscribed in the Registry.

10. For the state registration and inclusion in the Register addressees of all kinds of the foreign help
and grants represent accordingly to the Ministry of Economics and Finance of Turkmenistan and the
Ministry Adalat of Turkmenistan following the documents:
Application;
the documents necessary for formation database of the Register accordi ng to the applied list.
Forms and samples of such documents affirm accordingly the Ministry of Economics and Finance
of Turkmenistan and the Ministry Adalat of Turkmenistan.

11. After representation of the corresponding package of the documents:
The procedure of the state registration projects and programs of all kinds of the foreign help and
grants by inclusion of data on the project, the program or the grant in the Register with assignment
of identification number is carried out;
the conclusion about the state registration on established accordingly the Ministry of Economics and
Finance of Turkmenistan and the Ministry Adalat of Turkmenistan to forms stands out.

The conclusion about the state registration is assured by the seal accordingly the Ministry of
Economics and Finance of Turkmenistan or the Ministry Adalat of Turkmenistan.
The conclusion about the state registra tion stands out to the co -coordinator of the project, the
program of the foreign help or the grant or the person authorized by having the power of attorney
issued due hereunder with instructions of nameplate data.
Changes in the project data, the program o r the grant without fail represented accordingly to the
Ministry of Economics and Finance of Turkmenistan or the Ministry Adalat of Turkmenistan for
entering into the Register.
Data about registered in the Ministry Adalat of Turkmenistan projects and prog rams of all kinds of
the foreign help and the grants given for public associations, religious groups and the religious
organizations, are transferred by the specified Ministry in the Ministry of Economics and Finance of
Turkmenistan for inclusion in the Re gister.

12. The Agency and the Ministry Adalat of Turkmenistan shall prepare a report on the activities on
the registra tion of the projects and programmes of all kinds of foreign assistance and grants at the
end of each month to be submitted to the Cabinet of Ministers of Turkmenistan.
13. After each calendar month the Ministry of Economics and Finance of Turkmenistan and the
Ministry Adalat of Turkmenistan make the report on activity on registration of projects and
programs of all kinds of the foreign help and grants for the subsequent representation in the Cabinet
of Turkmenistan.

14. The documents and information, represented to the Ministry of Economics and Finance of
Turkmenistan, the Ministry A dalat of Turkmenistan or received from the Ministry of Economics
and Finance of Turkmenistan, the Ministry Adalat of Turkmenistan interested bodies and having
confidential character, are not subject to disclosure, the publication or transfer to the third p arties
without the consent of their owner.
