az adóbevallást helyettesítő munkáltatói elszámolás során a személyi
jövedelemadó meghatározott részéne k az adózó rendelkezése szerinti
közcélú felhasználásáról tett rendelkez ő nyilatkozatokkal összefügg ő
nyomtatványról

A személyi jövedelemadóról szóló 1995. évi CXVII. törvény (Szja. tv.) 81. §-ának (1) bekezdésében
kapott felhatalmazás alapján az Szja. tv. 45. §-ában foglalt rendelkezést megvalósító 1996. évi CXXVI.
törvény 5. §-a végrehajtása érdekében a következ őket rendelem el:
1. § A személyi jövedelemadó bevallást helyettesít ő munkáltatói elszámolás alkalmával a munkáltató a
részére átadott rendelkez ő nyilatkozatokról két példányban kísér őjegyzéket készít. A kísér őjegyzék
adattartalmára az adózás rendjér ől szóló 1990. évi XCI. törvény 96. §-ában adott felhat almazás alapján az
Adó- és Pénzügyi Ellen őrzési Hivatal tájékoztatót tesz közzé.
2. § A kísér őjegyzék egyik példányát a munkáltató a rendelkez ő nyilatkozattal együtt az adatszolgáltatás
keretében megküldi az illetékes adóhatóságnak, a másik példányt a rendelkez ő nyilatkozat éve utolsó
napjától számított öt évig meg őrzi.
3. § A nyilatkozatok átvételénél, kezelésénél, adóhatóságnak történ ő átadásánál az 1996. évi CXXVI.
törvény 5. §-ának (2) bekezd ésében foglalt adatvédelmi el őírások figyelembevételével kell eljárni.
4. § Ez a rendelet a kihirdetését követ ő 8. napon lép hatályba.
