Chapte r – 1
Preliminary

1 . Sho rt Ti tl e, Exten t an d Comm en c em en t:
(1) This Act ma y be c a lle d the
“Pre ve ntio n of Corruption Ac t, 2059 (2002 A.D.).” (2) It sha ll be e xte n de d t hro u gh ou t N e pa l a nd a p pli c a b le to a l l
Ne pa le se c it ize n s, pub l ic se r va n ts re s idin g a nywhe r e ou t sid e N e pa l a nd to
t he no n- N e p a le s e c it iz e ns re sid in g in for e ign c ou n t r ie s ha vin g c omm it t e d
a ny ac t tha t m a y be deeme d to be corruption under t his Ac t.
(3) It shall come into force immedia te ly.
2. De fi ni tion s:
In this Ac t, unle s s the c onte xt ot he rwise re qu ire s-
(a) “Corruption” means offe nce s punishable under Ch apter -2.
(b) ” Gr a ft ” m e a n s c a s h, goo ds or a n y t y pe of ga in o r b e ne fit a n d t he
te rm a lso inc ludes bribe.
(c)
“Public institution” means the following institutio ns:-
( 1) A c om p a n y, b a n k o r a c o m m i t t e e f u l l y o r p a rt i a l l y o w n e d
o r c o n t r o l l e d b y G o v e r n m e n t o f N e p a l; o r a
c o m m i s s i o n , orga niz at io n, au thor it y, c or pora t io n, a ca dem y,
boa r d, ce n te r, c o unc il or a n y o t h e r c or p o r a te bo d y o f s u c h

n a t u re e s t a b l is h e d by Go ve r n m e n t of Nepa l;
(2) A u ni ve r s ity, c o lle ge , sc h oo l, r e s e a r c h ce n ter a nd a ny ot he r
s im ila r a c a d e m i c o r e d u c a t i o n a l i n s t i t u t i o n r u n b y
Go v e r n m e n t o f N e p a l o r o n t h e fu l l o r p a rt ia l do n a t ion
fro m Go ve rn m e nt of N e pa l;
(3) Loca l bodies c o n s t i t u t e d under the Loca l Se lf- G overnance Act,
1999;
( 4) An i n s t i t u t i o n r u n o n l oa n, gr a n t o r gu a r a nt e e o f

o bt a ine d gra n t fr om such institution; and
( 6) An y o t he r i n s t i t u t io n p r e s c r i b e d a s p u b l ic i n s t i t u t i o n b y
Go ve r n m e n t o f N e p a l i n a n o t i fi c a t i o n pu b li s he d b y t he
N e p a l Gazette.
(d) ” P u b l i c S e r va n t ” m e a n s t he p e r s o n h o l d i n g a p u b l i c o ff i c e
u n d e r t h e pre va iling laws and the term also inc lude s the following
persons:-
( 1) p e r s o n a p p o i n t e d , n o m i n a t e d or e l e c t e d un d e r a n oa t h t o
Go ve r nme nt of Ne pa l or t o pu blic ins t itut ion, or u n d e r t he
term s, c on tra ct s or a gree m e n t s c onc lu de d w ith Go ver nm e nt of
Ne pa l or w ith a n y p ub l ic inst it u t io n, or h old ing a n y o f f i c e o f
p u b l i c r e s p o n s i b i l i t y f o r s a l a r y o r a l lo w a n c e s o r
rem une ra t ion or be ne fit or pos it io n w ith or w itho ut a ny t y pe
o f ga in from Go vernment of Nepa l or any public inst itution;
( 2) A p e r s o n a p po int e d as a n a r bitr at or or an y o t he r per s on
a pp oin te d in t h e s a m e p os i t io n p ur s ua n t t o t he p r e v a il i n g
l a w s t o r e so l ve or adjudicate any dispute;

a moun t o f th i s t yp e t o b e p a id or gi ve n to Go ve r nm e n t o f N e p a l
o r p ub l ic inst it u t ion, a nd t he te rm a lso inc lu de s i n tere st or fine to be
c ha r ge d o n s uc h tax, fee s, roya lty and other amount of this type.
(f) “De gre e of o ffe nce ” m e ans the de gree of offe nc e to be de termine d on
the ba s is o f c irc um sta nc e s a nd sit ua t ion in w hic h t he offe nc e ha s
bee n c o mm it t ed or a t t e m p te d t o b e c o m m it t e d , t h e gr a vit y o f su c h
o ffe nc e o r t h e i nt e nt io n , q ua l i fic a t ion , p o s it i on a n d c a p a c ity o f
t he pe r so n w ho h a s c om m i tt e d o r attempte d to commit any offe nce
punisha ble under this Ac t.

accepte d, it sha ll be confiscated.
(3) Whoeve r g ive s a gra ft to a public ser va nt or an y other person in order
to do or for be a r to d o a n y func t io n pur sua nt to Su b -S ec t ion ( 1) or ( 2),
s ha ll be l ia b le t o a punishme nt pursua nt to Sub-Sec tion (1) de pending on the
degree of the offense committe d. (4) Whoe ver a ba te s to commit a n offence punisha ble under this Section
sha ll, if he/she is a public servant, be liable to a punishment as same a s the
punishment prescribed for the same offence, and if he /she is any other person, shall
be liable to ha lf of the punishment for tha t offenc e on the basis of the de gree of the
offence irre spective of whe the r or not the offenc e ha s bee n comm itte d because of
suc h abe tment.
4. Pun ish me nt to Pu bli c Se rvants Ac ce pti n g Goo ds or Se rvi c e Fre e of Cost
or at L owe r Pri ce s: Whoe ve r, be ing a public ser vant, a cce pts or agre es or
attempts to ac ce pt, without a prior a pprova l of Go v ernme nt of Nepa l or public
institution, any goods or service free of cost or a t lower prices for him/herself or
for any other person, from a ny individua l, ha vin g k now le dge that suc h individual
is re late d to or is like ly to be re late d to any act related to his/her office or any act
carried out or to be carried out by him/herself is rela ted to any function of his
office, sha ll be lia ble to a punishment of imprison ment for a term from six m onths
to one yea r depe nding on the de gre e of the offe nce a nd a fine equal to the
amount in volved a nd in case such goods is a lready a ccepted, it sha ll be confiscated
and in case of the service, the price there of sha ll be fixed and a fine equa l to the
price of suc h service sha ll be im posed.

5. Pun ishme nt for Taki n g Gi ft, Pre sen t, Awa rd or Donation : (1) Whoeve r,
bein g a public ser vant, a c ce pts, without a prior a p pro va l Gove rnme nt of
Ne pal or a public institution, a ny type of donation , gifts, pre sents, awards or a ny
type of bene fit him/herself or through any me mber o f his/her fa m ily or other
person, so as to c ausing an impac t in any wa y on a n y of h is/ he r works whic h is
suppose d to be c a rried out by him/he r a cc ording to the office he /she assumes;
or any public ser vant who borrows from a person re l ate d to a work which he/she
has to carry out according to the office he assume s , sha ll be lia ble to a punishment
of imprisonme nt from three to six months de pending on the de gree of the offe nce
and the amount shall be c onfisca ted.
(2) Whoe ver, be ing a public se rva nt, ha s re ce ive d a ny prese nt or gift in
e xc hange of a gi ft o r pr e se n t b ro ugh t fro m t he a m o u nt of a fu nd
b e lo n g in g to Go ve r nm e n t o f N e pa l or a public instit ution, such gift or present
sha ll be immedia tely subm itte d to his/her office. I f not submitte d, it shall be
deemed to ha ve committed the offence re ferre d to in Sub-section (1) and such gift
or present sha ll be confiscate d ha ving him /her puni shed acc ordingly.
6. Pun ishme nt for Taki ng Comm issi on :
In c ase a n y t ype o f c om m issio n,
rem une ra t ion, brokera ge fee, be nefit or a d va nta ge i s liab le to be pa id while
perform in g dutie s by a public servant or while purc ha sing or hiring or ta king or
giving on a lease a ny commodity or ser vic e nec e ssa r y for Go ve rnme n t of
Ne pa l or a p ub l ic inst itu t io n or w h ile a w ardin g or a c ce ptin g a contra ct by
Go vernme nt of Ne pa l or a pub lic ins titu tio n or whi le selling or hiring or
takin g or givin g on a le a se any c ommodity or ser vic e produc ed by Go vernment
of Nepa l or a public institution, such comm ission, remuneration, brokera ge fe e,
bene fit or ad vantage shall be submitte d to the c onc e rne d offic e with in se ven
days from the date of receipt. In case not subm itte d as suc h, such public servant
sha ll be deemed to ha ve comm itte d the offe nce re fer re d to in Se ction 3 a nd the
amount sha ll be c onfisc a te d ha vin g him/her punished acc ordingly.

7. Pun ishme nt to Pu blic Se rvants for Leaki n g Reven ue: Whoe ver, be in g a
pub lic ser van t unde r the duty of c ollecting re ve nue s, causes re venue leaka ge or
help or abets a ny pe rson for it s le a ka ge ha vin g bee n in vol ve d him /her se lf in
a ny of the fo l low in g m an ner s, s ha ll be deeme d to ha ve comm itted the offe nce
referre d to in Section 3 with regard to the am ount of re ve nue so le a ke d a nd
he/she sha ll be lia b le to the sa me punishm e nt of im prisonme nt, a nd double of
the amount of re venue lea ked shall be fined: –
(a) To assist any pe rson in t he ac t of le ak ing re v enue in any m anner
wha tsoe ve r, ha ving ac c ep ted any c a sh or kind, fee , pr ize or dona t ion
or a ny type o f othe r be ne fit or forbear to collec t re venue or to a ssist or
cause to a ssist to collect less re venue having c a u s e d lo s s t o Go ve r n m e nt
o f N e p a l o r a p u b l ic i n st it ut io n by ta king or not t aking any type of ga in
from any person;
(b) To a sse ss or a s s is t t o a s s e s s le ss re ve n ue or t o a s se s s re ve n ue to
t he e ffe c t o f n o t c ha r gin g re ve nue a t a ll b y n ot go ing t hrou gh t he
doc ume nt s or not in ve s tiga tin g suc h d o c u m e nt s or by no t c o lle c t i n g
n e c e ss a r y e vid e nc e w h i le a s s e s s in g r e ve n u e a s requi re d by the
existing law;
( c ) T o e m be z z le t he r e ve n ue c o l le c t e d b y n o t de p os i t i n g it in
a c c o rd a n c e w it h t h e pre va iling laws;
(d) To re le as e or a ssis t t o re le a se go o ds, by m a k in g d iffe ren c e in t he
in vo ic e , qua lity or q ua n t i t y o f s uc h g o o d s, a n d w it h ou t c o ll e c t i n g
t he pr e sc r ib e d re ve n ue w h i l e assessing the re venue or carrying out
valuation of such goods.
8 . Pun ishme nt to Pu bl ic Se rvan ts for Ge tti n g Ille gal B e ne fit or Causi ng
Ille gal Loss with M ala fide Inte nti on: (1) Whoe ve r, be in g a public se r va nt,

ille ga l be ne fits for h im /he rse lf or for a ny ot her p erson, or of ca usin g loss to

im p r is o nm e n t o f a te r m fro m t hr e e m o n th s t o t h r e e y e a r s de pe n d in g on
t he de gre e o f o f fe n c e , a n d i n c a s e t h e a m o un t i n vo l v i n g th e o f fe n c e is
k no w n , s uc h a m o u n t s ha l l be c o n f i s c a t e d h a v i n g h im / h e r f in e d
a c c or d in g ly . I n c a s e s u c h a m o u n t i s n o t k n o w n , a n i m pr is on me nt for
a te r m fr om t hre e m o n th s t o t hre e ye a r s a n d a fin e from t e n t ho us a nd to
fifty thousa nd rupees sha ll be im posed.

study of, or setting norm s for, a projec t.

q ua l it y t ha n t ha t o f t he p re s c r i be d q ua l i t y , o r t o c e rt i fy or
t o a p p ro ve t he u s e o f su c h m a t e r ia l s a s t he materia ls of
prescribed qua lity;
(c) To d e gra d e the qua lity o f c o ns truc tion w ork or to c ha n ge the
form or shape t here of or t o c a r r y ou t o r c a u s e t o c a r r y o u t
c on s t r u c t i o n w or k s i n c o n t r a ve n t i o n o f t h e pr e s c r ib e d
t e r m s , c o n d it i o n s a n d s t a n da r d; o r t o c e r t if y o r t o
a p p r o ve s uc h c o n st r u c t i on w or k a s q u a l ita t i ve a n d u n d e r
t he pr e sc r ib e d t e r m s a n d c on d i t i on s w ithout any rea sonable
ground;
(d) To c a r r y o ut or ca use to c a rr y ou t c o ns tr uc t io n w ork s ha vin g
inc rea se d or a m en de d the costs estima te in an unna t ura l manner
and without any reasona ble ground;
( e ) T o gi ve o r r e c e i ve p a ym e n t h a vin g pr e pa re d fa ls e b il ls or
r e c e ip t s o r t o gi ve or receive double payment of bi lls;
(f) To p r o c u r e or c a us e t o pr oc ure e xc e s s ive qua n t i ty of go o ds in
a n u nn at ura l manner than the quantity nee ded withou t reasonable

grounds;
( g) T o c a r r y ou t or c a u s e t o c a rr y ou t u n n a tu r a l va lua t io n o f a
g o ve r n m e nt property, a property of a public organiz ation or of
public property;
(h) To r e g ist e r, occ upy or use or to c ause t o re gis te r, oc cupy or use
a go ve rnm en t or pu bl ic p r ope r t y in o n e ‘s ow n na me o r in t he
na m e o f o t he r in a n i l le ga l manner;
(i) To va lue or c a u s e t o va lue a c o lla tera l sec urit y t o be
mort ga ge d in t he nam e of a go ve r nm e n ta l o r p ub lic
orga niz a t ion in an e xc e s s ive a n d u nr ea s ona ble price s than the
rea l pric es;
( j) To pr oc ure or c au se t o proc ure goo d s o f de grad i n g q ua lit y,
da te e x pire d a n d t o pr o c u r e or c a us e t o p ro c ur e g o o d s
h a v i n g pa id h i g h e r p r ic e s i n a n unnatura l manner.
(2) In c ase a ny p ub lic se r va n t d oe s n ot re turn a ve hic le or a fa c il ity
a va ila b le to him/ her by vir tue o f h is /he r o ffic ia l po sit ion w ith in t he
pre scr ibed t ime a fter t he e xp iry of the offic ia l po s it io n w it h ou t a ny
rea sona ble gr ou nd, he /she sha l l b e lia ble t o a fine from o ne tho usa nd to
fi ve t hou sa nd ru pe e s de pe ndin g o n t he de gre e o f t he offe ns e a nd s uc h
ve h ic le or fa c ilit y s ha l l be taken bac k.
(3) Whoe ver, be ing a pu blic se r va nt, c a use s a ny ty p e of los s t o a
go ve rnme n ta l o r p u b lic p r o p e r t y w it h m a l a fi d e i nt e nt io n h a vi n g
c om m it te d a n y a c t e x c lu d in g t he a c t s re ferred to in Sub-Sec tion (1) and (2),
sha ll be lia ble to a punishment of imprisonme nt not e xc e e din g tw o ye ar s or of
a fin e e qu a l t o t he am ou n t o f t he los s or b o th de pe n din g o n t he de gree of
the offe nce. ( 4) I n c a s e a n y pe r so n o t he r t h a n a p u b li c s e r va nt , w it h m a l a
f i de in te n t i o n o f m a k i n g i l le ga l ga in to h im / h e r s e l f o r t o a n y ot h e r

p e r s on , d oe s n o t a b id e b y t h e t e r m s a n d c ondit ion s o f a n oa t h,
unde rta kin g, a gr ee me nt, c ontr a ct, lice n se , pe rm it, pr om iss ory note or
dea lers hip e ntere d int o w ith Go ver nme nt of Ne pa l o r a p ublic ins t itut ion or

according to the amount of loss and the amount of l oss sha ll be confiscated.

acting a s the princ ipa l offic ial in case of a compa ny or a c orpora te body shall be
deemed to ha ve comm itte d the offence.
Provide d that, in case it is proved that suc h act has been comm itted prior to
the a ppointme nt of the person a ctin g a s the princ ip a l offic ial, the person who has
com mitted the ac t sha ll be deemed to ha ve comm itte d the offe nce.
Explanation:
For the purpose of this Sec tion, the “the pe rson ac ting as the
princ ipa l offic ial” mea ns the Chairma n, Board Membe r, Ge nera l Ma nager,
Ma naging Direc tor or the Officia l of a com pany or c orporate body working in
the same capac ity.
24. Ad diti onal Punishment:
In case the offe nce s under this cha pter ha ve been
committed by an office bearer of a constitutiona l o rgan or body to be nom ina ted or
appointe d by offic er be lo nging to the spe cia l c lass of Go ve rnm e nt of Ne pa l or
offic ers o f e qu iva le nt rank; Head, General Ma nager or officer of a public
institution of equiva lent ra nk, such person sha ll b e lia ble to the punishment of
imprisonme nt for a term of three years in a ddition to the punishment pre scribed for
suc h offence.
Chapter – 3
Inve stigations, In qui ries an d Filling of Cases of C orru ption
25. Inve stigations an d Inquiries:
(1) In ca se the investiga ting authority comes to
know, through any informa tion, source or a c om pla in t lodged by any person, that
any person ha s c ommitted or is going to comm it corr uption, it sha ll initia te
necessary investigations, inquiries and other actio ns in this regard.

( 2) N o t w i t h s t a n d i n g a ny t h i n g c o n t a in e d i n S u b – S e c ti o n ( 1 ),
i n c a s e t h e in vestigating a uthority ha s rece ive d in form ation from a ny source that
any person ha s c om m itted or is go ing to c om m it c orr upt ion, such author ity
ma y ta ke imm ed iate a c t ions inc luding raid, se izure of docume nts or goods and
materia ls or arrest of person.
26. Pre l imi nary Inqui ry:
The in vest iga tin g a uthority shall, upon ha ving rece ived
a c ompla int or informa t ion tha t one ha s c omm it te d o r is goin g to c omm it an

source during the course of inve stigation into offe nces of corruption that there has
been financ ia l transaction or operation of an ac c ou nt in the nam e of a ny person
with a ny bank or fina ncia l inst itut ion with in the c o untry or in an y fore ign
c oun try, t he inve st iga t ing au thor ity m a y order to f re e ze suc h transac tion or
account. The concerned bank or financ ia l institute sha ll freeze suc h transaction or
account in accorda nce w ith the order of the in ve sti ga ting a uthority.
P ro vide d tha t in ca se suc h tra nsa ct ion or a cc o unt to be fre ez e is w ith
a ba nk or financ ial institution in a fore ign countr y, the inve stigation authority
may cause to freeze the operation of transaction or account through the diploma tic
channe l. (2) The investiga ting authority ma y im pose a fine o f fifty thousa nd rupees

in m aximum to t he c hie f o f the c onc e rne d bank or financ ia l institu tion loca ted
in N epa l not freez ing transactions or accounts purs uant to Sub-sec tion (1).
(3) The in vestigation authority may, if it deems fi t in the course of
investigation, ac c ordin g to the ne e d, a sk for the s tate me nt of prope rty
belonging to pe rsons hold ing an office of public re sponsibility or freeze such
property.

(1), the summon sha ll be ser ved to the ma in place o f transaction, or to the address
of such person where he reside s perma ne ntly, or to the addre ss of corre sponde nce
give n by such person in c onne ction with his busine s s transaction through the

mea ns of telex, fax or any other means o f t e le c om m un ic a t io n in w r it t e n
for m o r t h r o u g h r e gi s t e r e d p o s t, a nd t h e s um m o ns se r ve d i n a ny of such
manners shall be dee med to ha ve been duly made.
(3) Notwithsta nd ing anything conta ine d in Sub-sec ti ons (1) or (2),

it by this Act to any of the Government of Nepa l’s gaze tted le vel officers.

59. S pe c i a l P ro v i si on s R el a ti n g t o C a s e s of C o rr u p t i on :
N otw ithsta ndin g
a nythin g c onta ined in the pre vailing law s, it sha ll be a s follow s in the
following ma tters with rega rd to the c ase s filed un der this Ac t:-

(a) In ca se any public serva nt or any other person has, while c ommitting or in
connection with com mitting an ac t that is deemed to be an offence under
other pre va iling laws, there sha ll be no hindrance to file separa te case in
acc orda nce with othe r pre va ilin g laws.
(b) In case there ha s be e n a dve rse im pa c t caused on the rights, prope rty or
inte rests of any person w hile c omm itting or in c onn e ction with c omm itting
an act that is deemed to be an offe nce under this A c t by a public servant or
any other person, there sha ll be no hindrance for s uch person to file a
separate case.
(c) In c ase s w here a ca se ha s be en file d a ga inst a person for a n offe nce
unde r this Ac t a nd it appe a rs late r on, after ha vin g e xam ine d the
e videnc e, tha t the c a se must be filed a gainst other person a s well, there
sha ll be no hindra nce to file a separate charge she et a ga inst such person.
(d) Nothin g shall be de em e d to pre vent fillin g of a se para te ca se a ga in st
a ny pub lic serva nt or pe rson for offe nses to be lia ble under this Act, e ven
if the se parate ca se has bee n a lrea dy file d a gainst suc h pe rson in order to
rec o ver loss a nd dam age s ma de by such pe rson to Go v ernment of Nepal
or public institution illega lly;
(e) In case, whe re a ca se has been filed under this Ac t aga inst a ny public
serva nt or other person, there shall be no hindranc e to file a case under this
Act or the case filed shall not be dismisse d mere ly for the re a son that
the re is a le ga l provis ion of rec ove ry of the loss ca use d to Go vernment of
Nepal or a public institution from such public serv ant or other person.
(f) No cases filed under this Ac t shall be withdraw n or com promised.

6 1. U n c l a i me d g oo ds to be en ti tl e d to G o ve r n m e n t o f N e p al :
(1) In case

no owner of the goods re late d to the offe nce punishable under this Act is trace d,
the inve st igating authority sha ll publish a public notice re quiring the cla ima nt, if
any, of the goods so seized to c la im the goods, wit hin a time lim it of thirty five
days. (2) In case, no c laim is m ade within the time limit re fe rre d to in sub-
sec tion (1) or even if the c laim is ma de but in abs e nce of proof the cla im is not
tena ble, suc h goods sha ll be the property of Go vern me nt of Nepa l ha ving treated
suc h goods as unc laimed goods.
62 . G o o ds m a y be s ol d:
(1) In case it a ppears that any goods se ize d in con nection
with a n offence punishable under this Act would be dama ge d or broken for
storing for a long time due to rust or for any othe r rea son or would be rotten or
damage d or price of such goods would go down for be ing old or w ould be
use le ss or it c ould not be store d or ma inta ine d for lack of spa ce, suc h goo ds
ma y be s o ld ha ving c om p le te d t he proce s s t he re o f in ac c or dance w it h the
pre vailing laws. ( 2) T he a m o u nt receive d fro m t he sa le p ur s ua nt t o Su b -s e c t ion
( 1) sh a ll b e deposited to the de posit acc ounts. In case it has been dec ided that
suc h goods has to be give n to the c oncerne d owner, he sha ll be entitled only to the
amount receive d from the sa le.

implementing the objectives of this Ac t.

(1) The following Sections of the Re venue
(Investigation and Control) Act, 2052 have been rep eale d,-
(a) Clause (c) of Section 2;
(b) Sub-section (2) of Se ction 6;

(c) The terms “or employee ” appearing in sub-Section (4) of Section 9;
(d) Sub-section (2) of Se ction 18;
(e) Sub-section (2) of Se ction 21;
(f) Sub-section (2) of Se ction 23;
(g) The terms “or c orruption” fre que ntly used in pl ace to place ;
(h) Sec tion 5, chapter 4 a nd Section 25.
(2) The P r e ve n t io n of Corruption Ac t, 2017 has been re pea le d.
(3) All a c t ion s take n a nd proce e dings in itia ted und er the P re ve ntion of
Corruption Ac t, 2017 shall be deemed to have been t aken or initiated under
this Act.
