Jordan: Legal Challenges and Opportunities for Digital Fundraising

يمثل التحول الرقمي في القطاع المالي في الأردن فرصة مهمة أمام منظمات المجتمع المدني لتنويع مصادر دخلها وتطوير أساليب أكثر ابتكاراً ومرونة لجمع التبرعات والتمويل. إلا أن الاستفادة من هذه الفرصة لا تزال محدودة، نتيجة حداثة منظومة التمويل الرقمي، وضعف وعي المنظمات بالأدوات الرقمية المتاحة، ومحدودية ثقافة التبرع الإلكتروني، إلى جانب التحديات القانونية والتنظيمية التي تحيط بعمليات جمع التبرعات وتلقي التمويل.

تظهر الدراسة أن الإطار القانوني الناظم لعمل منظمات المجتمع المدني في الأردن يتسم بالتعدد والتعقيد، نتيجة خضوع المنظمات لعدد من القوانين والأنظمة وتعدد الجهات الحكومية ذات الصلة. ويشمل ذلك قانون الجمعيات رقم (51) لسنة 2008، والتشريعات الناظمة للشركات التي لا تهدف إلى تحقيق الربح، إضافة إلى التطورات التشريعية الأخيرة، ولا سيما قانون التخطيط والتعاون الدولي لسنة 2024، وقانون التنمية الاجتماعية لسنة 2024، ونظام ترخيص جمع التبرعات رقم (24) لسنة 2025.

وقد شكل نظام ترخيص جمع التبرعات لسنة 2025 تطوراً مهماً باعتباره أول إطار تشريعي أردني يعترف صراحة بإمكانية جمع التبرعات باستخدام الوسائل الإلكترونية. ومع ذلك، لا تزال بعض أدوات التمويل الرقمي الحديثة، مثل الرسائل النصية القصيرة (SMS)، والتمويل الجماعي، وأدوات الذكاء الاصطناعي، تفتقر إلى تنظيم واضح ومحدد. كما لا يزال الإطار القانوني غير واضح بشأن إمكانية استخدام الأصول الافتراضية والعملات المشفرة في تمويل منظمات المجتمع المدني، في ظل غياب تعليمات تنظيمية صريحة بهذا الخصوص واستمرار العمل بالتعاميم الصادرة عن البنك المركزي الأردني

تؤكد الدراسة أن الأردن يمتلك فرصة حقيقية للاستفادة من التحول الرقمي لتوسيع وتنويع مصادر تمويل منظمات المجتمع المدني، إلا أن تحقيق هذه الفرصة يتطلب الانتقال من الاعتراف المحدود بالتمويل الرقمي إلى بناء منظومة قانونية وتنظيمية متكاملة وميسرة. ويشمل ذلك تبسيط إجراءات الترخيص، وتنظيم أدوات التمويل الحديثة، وتسهيل الوصول إلى الخدمات المالية، وتطوير قدرات المنظمات، مع ضمان متطلبات الشفافية ومكافحة غسل الأموال وتمويل الإرهاب. ومن شأن تبني هذه الإصلاحات أن يسهم في تعزيز الاستدامة المالية لمنظمات المجتمع المدني، ودعم قدرتها على الابتكار، وتوسيع مشاركتها في التنمية، وتعزيز بيئة مواتية للعمل المدني في الأردن.

Digital transformation in Jordan’s financial sector presents an important opportunity for civil society organizations (CSOs) to diversify their sources of income and adopt more innovative, flexible, and accessible fundraising methods. However, the use of digital fundraising tools remains limited. This is due, among other factors, to the relatively recent development of Jordan’s digital financial ecosystem, limited awareness among CSOs of available digital fundraising tools, and a still-emerging culture of digital giving among the public.

This report finds that the legal and regulatory framework governing CSOs in Jordan is complex and fragmented, with organizations operating under multiple laws and regulations and interacting with several government authorities. The principal legal frameworks include the Associations Law No. 51 of 2008, legislation governing nonprofit companies, and more recent reforms, including the Planning and International Cooperation Law of 2024, the Social Development Law of 2024, and the Fundraising Licensing Regulation No. 24 of 2025.

The 2025 Fundraising Licensing Regulation represents an important development, as it is the first Jordanian legal framework to explicitly recognize electronic fundraising. Nevertheless, several emerging digital fundraising mechanisms—including SMS donations, crowdfunding, and AI-enabled fundraising tools—remain insufficiently regulated or lack clear legal frameworks. Similarly, the regulatory environment remains unclear regarding the use of virtual assets and cryptocurrencies to support CSOs, due to the absence of specific regulations and the continued application of Central Bank of Jordan circulars restricting such activities.

Jordan has a significant opportunity to leverage digital transformation to expand and diversify funding opportunities for civil society organizations. However, realizing this potential requires moving beyond the limited recognition of digital fundraising toward the development of a comprehensive, coherent, and enabling legal and regulatory framework. This includes simplifying licensing procedures, regulating emerging fundraising mechanisms, facilitating access to financial services, strengthening CSO capacities, and ensuring appropriate safeguards for transparency and the prevention of money laundering and terrorist financing. Together, these reforms can strengthen the financial sustainability of civil society organizations, enhance their capacity for innovation, expand their contribution to national development, and create a more enabling environment for civic action in Jordan.
