DONATARIAS Y DONATIVOS DEDUCIBLES, ¿FUNCIÓN SOCIAL REAL O AGENCIAS DE RELACIONES PÚBLICAS? En una de las tantas discusiones sobre este tema, durante una sesión pública de la Comisión de Hacienda del Senado, escuché a cierto senador (así, con minúscula) de la República (así, con mayúscula) decir que las fundaciones y otras donatarias autorizadas no eran más que “agencias de relaciones públicas de los empresarios” que además de lucirse querían deducir esos gastos. De esa y otras discusiones nació el límite de 7% a la deducción de donativos a entidades filantrópicas. Con el riesgo de al darles de entrada lo que debiera ser mi opinión final, decidan que ya no vale la pena leer este artículo, no puedo dejar de expresar que semejante afirmación me parece una estupidez, por decir lo menos. Me explico: Cuando una persona decide donar a una fundación, a una institución de asistencia privada (IAP) o a una asociación civil (AC) autorizada para expedir recibos deducibles de impuestos por los donativos que reciba, no está haciendo ningún tipo de negocio ni tomando ventaja económica alguna en relación con sus impuestos; lo único que sucede es que en lugar de destinar una parte de sus utilidades al fisco, dedica esa parte y mucho más (tres veces más) a una actividad filantrópica. […]
